1. Acceptance of Terms
By accessing or using Makefolio (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access the Service.
2. Account Responsibilities
You are responsible for safeguarding the credentials you use to access the Service and for any activity that occurs under your account. You must provide accurate and complete information when creating an account and keep it up to date. You must notify us immediately if you suspect any unauthorized use of your account.
3. Content Ownership
You retain full ownership of the content you upload, including project images, case studies, written copy, and any other material. By uploading content, you grant Makefolio a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content solely for the purpose of operating the Service. You are responsible for ensuring you have the rights to any content you publish through the Service.
4. Prohibited Uses
You agree not to use the Service to upload, transmit, or distribute any content that is unlawful, infringing, defamatory, harassing, or otherwise objectionable. You must not attempt to probe, scan, or test the vulnerability of the Service, breach security or authentication measures, or interfere with any other user’s use of the Service. Automated scraping, spamming, and abuse of API rate limits are strictly prohibited.
5. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these terms or if your use of the Service places undue burden on our infrastructure. You may delete your account at any time from your dashboard. On termination, your portfolio will no longer be publicly accessible and your data will be removed according to our data retention policy.
6. Limitation of Liability
The Service is provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, Makefolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
7. Changes to These Terms
We may update these terms from time to time to reflect changes to the Service or applicable law. We will notify you of material changes by email or through a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
